If you want to ask a question and you are not on the agenda, you must raise your hand, get permission from the Chairman, and come to the microphone before speaking. If you are on the agenda the same rule applies. THE VILLAGE BOARD HAS THE RIGHT TO MODIFY THE AGENDA AT THE REGULAR MEETING WHEN CONVENED. MEETING IS OPEN TO THE PUBLIC. A COPY OF THE OPEN MEETINGS ACT IS LOCATED ON THE NORTH WALL. A COPY OF THE MEETING NOTICE WAS POSTED AT THE CITY HALL, POST OFFICE, FIRST NEBRASKA BANK, AND DECATUR EXPRESS. The Village Board reserves the right to go into executive session for matters appropriate under the Nebraska Open Meetings Act. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. Hightree made a motion to come out of executive session at 6:10 PM. Troutman seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Hightree-yes, Troutman-yes. Troutman made a motion to give the Part-Time Police $32.00 an hour. Hightree seconded the motion. Roll Call: Kirschenman-yes, Anderson-yes, McCullock-yes, Troutman-yes, Hightree-yes. Motion Carries. Lights: Monthly Report A. Tree Trimming. We have a bid from Beatty Tree service, but have not received the bid from Swick Tree Trimming. Hightree stated that there were two meters pulled, and one was put right back in. Hightree picked up the 24 light meters from Laurel Nebraska. Larry McCullock ordered 10 new street lights which were $130.00 each. Water & Sewer: Monthly Report A. Water Loss-9.74%. The maintenance crew have fixed several water leaks, one resident had his water leak fixed and Cass Plumbing & HVAC are here today replacing the fire hydrant at the Green Lantern that was leaking. Rod Nelson asked what the line going over the creek on 11th street was for? Troutman stated it is the sewer line. Drainage Ditch Troutman had a person come to him and ask if he cleans all of the trees out of the drainage ditch and take the rock from the recycling center and place them in the ditch for erosion control by the sewer plant for no cost, if he could have all of the old grindings (which are useless to the Village) at the recycling plant? All the Board members were in agreement. Anderson stated the Village should draw up an agreement and have him and the Village sign it. Possibly have it done before cleanup day. Larry McCullock has the maintenance crew signed up for the classes they need for sewer and water. Mike will be going to a 5-day class for water and take the black car, he will then take the test in water on the first Monday in May. Skylar will be going to take the sewer test in Grand Island and will be taking his own vehicle and the Village will pay him mileage. Parks: Monthly Report – No Income Rock Pads and Road on top level with red rock. $1,426.00 a load. Hightree made a motion to order the load of red rock. Troutman seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Hightree-yes, Troutman-yes. The rules of the campground are first come first serve. If you want to reserve a spot you have to pay from the time you want it. There are no saving spots for anyone without payment first. It was decided to open the park April 1, 2025 weather permitting. The shower houses Will not be open until we know the cold weather is over. Streets: Monthly Report March Highway Allocation-$7,450.92. December 2024 Sales Tax $6,564.82, $5,241.29 to LB840. The street to the camp ground really needs some work. The Village has been discussing for some time to widen West 5th Avenue that goes to the cemetery, which is a very major cost. Kirschenman had an idea to make west 5th avenue a one-way street from Rex Sears property so that it does not have to widened and use west 8th street to continue the one way to the Methodist Church. Kirschenman stated that maybe the Village could talk with our Engineer to see if this would work. Sears Center: Monthly Report Nothing to report. 6) OLD BUSINESS: 1. Greg and Amy Jump-Agreement. Greg nor Amy did not attend the meeting. The Clerk spoke with Greg about the agreement, he stated he had a question, but the Clerk never heard back from him. 2. JDS Security, LLC-Service Agreement. Shane is not able to come to this meeting. The Village Attorney had some additions to the agreement. The Clerk sent the changes to Shane. Tabled until the April meeting. Anderson stated that if everything is worked out with the agreement, we will need to notify the public that the Village is not doing the Ordinances, it will be the JDS Security Company. The Clerk will publicize this, by newspaper, notices around the Village and in everyone’s utility bill. Hightree asked if we would have to work on the Ordinances? The only Ordinance will be the fine fees. 3. Maple Villa Update. This item was tabled. NEW BUSINESS Greg Carlson-Water Shutoff at the Marina. Greg and Sharon came to the table to discuss the pole that is protecting the water shutoff coming off of Snow Avenue to Decatur Drive. The residents do not have enough room to make it around the corner with running over the shutoff and breaking it. The Village put this pole there to protect it. Carlsons bought an electrical box that is made from fiberglass and it is guaranteed to hold 20,000 pounds, so the pole can be removed. Troutman stated that he would like to Carlson’s to take responsibility for the shutoff if this doesn’t work. Greg stated he was okay with this, but asked why it would be their responsibility if it is the Village Infrastructure? Troutman stated because the Village would be taking the pole out that is protecting the Village infrastructure. Greg stated it was not there before, and Troutman stated that is why it broke. Carlson stated they were willing to agree to this if the Village would dig up the pole? Troutman stated the Village would dig up the pole and put the box in. Carlson stated that he had another concern about the fill dirt. If the box sinks, will it break the shutoff? Troutman stated the maintenance crew will pack the dirt as much as they can, and add some clay dirt. Carlson asked if it should be encased in concrete? Troutman stated if it starts leaking then the Village would have to break out the concrete to fix it. Anderson stated that we need to have an agreement drawn up and have it signed. Hightree made a motion to allow the pole to be taken out and put the box in that Carlson’s bought to protect the shutoff. Troutman seconded the motion. Troutman made a motion to open the Public Hearing on Rock River Venture Capital, LLC (Pop-n-Doc’s)-Liquor License. Hightree seconded the motion. Bid for Replacing Fire Hydrant on the corner of 7th Street and Broadway (Green Lantern). $10,950.00. This fire hydrant has a leak. The leak was found by Rural Water. Ordinance 90.03C Campground Rates. The Clerk read the Ordinance. ORDINANCE § 90.03C AN ORDINANCE TO AMEND ORDINANCE § 90.03B OF THE CODE OF DECATUR TO PROVIDE AND CLARIFY PARKS AND CAMPGROUND RULES, REGULATIONS AUTHORIZED; TO REPEAL CONFLICTING ORDINANCES AND SECTIONS; AND TO PROVIDE ANEFFECTIVE DATE. BE IT ORDAINED BY THE CHAIRPERSON AND BOARD OF TRUSTEES OF THE VILLAGE OF DECATUR, NEBRASKA. SECTION 1. Ordinance § 90.03B of the code of Decatur, Nebraska shall be amended to read as follows: Ordinance § 90.03C PARKS AND CAMPGROUND RULES, REGULATIONS AUTHORIZED. The Village Board of Trustees are hereby authorized to make and establish all needful rules, not inconsistent with any of the provisions of this chapter, as amended or hereafter amended, regulating the use of all parks, playgrounds and campgrounds belonging to or operated by the Village. Such rules shall be prepared at the direction of the Chairman and submitted to the Village Board for approval, after which time they shall be considered a binding part of this chapter; and a violation of any rules shall be punished as provided in § 10.99. (1995 Code, § 1-605, 2006 Code, § 90.03, 2016 Code, § 90.03B) All camp sites need to be paid up to date or will be subject to towing or removal of said camper(s), tent (s) and any other property left on an unpaid and not legally registered up to date site at the owner’s expense. Removal of a current registration card for a camp site is a crime. Anyone removing another’s legal and current registration slip for a camp site faces both a criminal citation and removal from the park. Any campsite fees that they have paid while in commission of a crime will be forfeited. Campsites are designated for the use of one camper in the event that any other campers or vehicles or tents are also on the same campsite and are plugged into the electrical box each will be charged at a separate camper cost of $28.00 for the upper-level, and $25.00 for the lower-level. The following rules and regulations shall be displayed in a prominent area in the park: Welcome to Beck Memorial Campground and Busse & Brewer Addition Being confronted with the ever-increasing demands for outdoor recreation, it is imperative that all persons respect this village-owned land provided for you, so that each user may benefit from its purpose. The Village of Decatur has therefore adopted the following rules and regulations for the protection, regulation, and control of our park. Please respect our rules and regulations!! CAMPGROUND RULES Please register within one hour of arriving. Campers must re-register or vacate your site by 1:00 P.M One camper, one boat trailer per site You can save sites only by paying for the site and filling out the envelope then displaying it on the post that corresponds with the site. Action will be taken if this is not done. 5. One tent will be allowed, with a camper, per site, without extra fee, for children 18 years or younger. All other tents are $12.00. A tent on an Electrical Site is subject to the $25.00 or $28.00 fee (Depending on level) 6. Carpets that don’t damage the grass are allowed. 7. No fires except in fire rings. Do not move fire rings. 8. No animals, vehicles, or vessels shall be hitched or tied to any tree or shrub, or in such a manner as to result in injury to Village property. Pets must be on a leash. Please clean up after your pet. 9. Excessively loaded vehicles shall not operate over Village Park drives. Determination as to whether the load is excessive will be made by the Village Board or its representatives and will depend on the load and road conditions. 10. A dumpster is provided beside the boat trailer parking lot. 11. If you use the fish cleaning station, please leave it as you found it. 12. No excessive noise from 10:00 P.M. until 6:00 A.M. Dock / Boat Ramp Rules No unattended boats allowed. All trailers must be parked in designated parking only unless you have a paid site. Lower-Level Electrical Site Parking $25.00 (Includes Tax) Upper-Level Electrical Site Parking $28.00 (Includes Tax) Tents Set-up off an Electrical Site $12.00 (Includes Tax) Tents Set-up on an Electrical Site $25.00 or $28.00 depending on level (Includes Tax) If staying for 30 consecutive days the price for Upper and Lower-Level Electrical Site is $575.00 (Includes Tax) must be paid at one time. Cleanup Day The Board discussed changing companies for cleanup day. It was decided to stay with Carrier Containers out of Onawa, IA. The board chose two dates May 17th or May 24th. The Clerk will contact Carier Containers to see which date would work for them. Troutman asked about the metal for cleanup day, the same one that has been doing it? Everyone was in agreement to stay with the person that hauls away the metal. The Clerk will call Red Barn tomorrow, to get the Vet Clinic Scheduled. McCullock asked if we still had a good turn out for the Vet Clinic? The Clerk stated we do. Rod Nelson-Dogs at Large/Culvert Clean Out. There has been a yellow lab at his property for most of the week, he finally found out who it belonged to, so he called her to come and get the dog out of his kennel. He stated that the Village really needs to find someone to take care of the dogs that run at large. He destroyed his wife’s garden and part of his yard. There is a culvert on his property along the highway that needs to be cleaned out. He stated that he has done a lot of work there for erosion and to help with drainage, he has an issue from the driveway to the garage, that is the culvert that is plugged. He has tried to clean it out himself with no avail, it is on the State Right-of-Way. Larry McCullock and the State guy came and looked at the culvert. The guy from the State stated he would work with Larry to get this done. They were going to clean it out last year but never got to it. There is a culvert that runs east and west that has a hole in the top of it. Rob thought it was a 30-inch culvert. Troutman and Hightree will take a look at this. Bids for Basement and Hall Floor Restoration. Carol Freese Cleaning and Painting submitted a bid for stripping, polishing and waxing the dining room floor in the basement. $3,973.90. The board discussed having Rob Sparks do this. We will get in touch with Floor Maintenance and see what we have to have to get this done.
