VILLAGE OF DECATUR REGULAR BOARD MEETING June 12th, 2025 @ 4:30 PM NOTE: Everyone must use the microphones at the table. The audience must be quiet during the meeting. If you want to ask a question and you are not on the agenda, you must raise your hand, get permission from the Chairman, and come to the microphone before speaking. If you are on the agenda the same rule applies. THE VILLAGE BOARD HAS THE RIGHT TO MODIFY THE AGENDA AT THE REGULAR MEETING WHEN CONVENED. MEETING IS OPEN TO THE PUBLIC. Police: Monthly Report Anderson stated the Village Board hired another part-time Police Officer. Troutman stated he is doing a good job; he helped with some life-saving interventions. Anderson stated he needed to be recognized for his interventions. Anderson stated that we have an application for a full-time officer that is not certified. He asked if the Board would like to set up interviews with him? Troutman stated that we should ask him for an interview. We will notify Chief Hedlund to schedule a fitness test with the applicant and evaluate him. The Board will schedule a special meeting for this. Officer Archer is working on Saturday. 2. Lights: Monthly Report Everyone paid their bills, the poles from the storm in March have all been replaced. The Village is working with FEMA to try and recoup the money spent from the storm. Troutman and Anderson sat in on the meeting with the Emergency Manager. 3. Water & Sewer: Monthly Report A. The Village had a 9.79% water loss for last month. There have been four leaks that have been fixed. If anyone sees a leak please let the Village know so that we can get it fixed. Troutman will speak with Steve Cass to see if we can put a water meter at the Splash Pad. B. Advertise for Full-Time Maintenance Person. Troutman stated to advertise until the position has been filled. The candidate has to become Certified in sewer and water. Skylar will be taking the sewer test on June 26th in Wahoo. 4. Parks: Monthly Report – May Income of $14,008.35 McCullock stated that the Splash Pad is open and we are trying to monitor the water usage. If it continues to stay hot and dry, we may have to cut the hours. McCullock mentioned the fish cleaning station. Hightree stated he did meet with the State to discuss another kind of fish cleaning station. The cost of the new fish cleaning station would cost anywhere from $40,000.00 to $80,000.00 depending on the size. There are grants available we just have to apply for them. The State highly recommends this new system. The State has had the new system for three years and has not had any problems. Kirschenman asked if we needed the fish cleaning station? Hightree stated that the one we had was used frequently. The system is enclosed so nothing can get in to ruin it. Troutman stated there was a water leak in spot #0 at the campground, but has been fixed. 5. Streets: Monthly Report A. June Highway Allocation-$6,792.59 B. March 2025 Sales Tax Received in May 2025 $4,458.31, $3,014.16 to LB840. C. Block Off Broadway in Front of Firehall, Friday Night of Riverfront Days. Troutman made a motion to block the street in front of the firehall Friday night. Kirschenman seconded the motion. Roll Call: Hightree-yes, Anderson-yes, McCullock-yes, Troutman-yes, Kirschenman-yes. Motion Carries. Kirschenman stated the road behind Troutman’s house needs to be bladed. 6. Sears Center: Monthly Report A. Nothing to Report The new custodian seems to be doing a good job. 7. Community Center Building Report A. The sound proofing is up in the basement. Hightree stated the new sound proofing panels have been placed in the basement, and we had Three extra panels so the Boden Construction hung the rest in the big hall. He would like to order more when funding allows. Troutman stated to put $3,500.00 in next fiscal year’s budget for the sound panels. 8. There is a weekly report that Signal 88 gives the Village every week. 6) NEW BUSINESS 1.Public Hearing for CDBG Grant. Zach Fisher came to the table; he explained that he is a Community Planner with the Northeast Nebraska Economic Development District. He is here due to the Village requesting $53,000.00 for the Development of a Downtown Revitalization Plan. $50.000.00 will be used for planning and $3,000.00 will be used for general administration. The Village will supply a match of no less than $5,000.00. The total cost would be $58,000.00. Troutman made a motion to open the Public Hearing on the Village Applying for a $53,000.00 grant for the Development of a Downtown Revitalization Plan. Hightree seconded the motion. Roll Call: Anderson-yes, Kirschenman-yes, McCullock-yes, Troutman-yes, Hightree-yes. It was asked what these funds will be used for? Zach stated that these funds will be used for the Planning of the Downtown Revitalization. The Planning involves the buildings and everything in the downtown area. It was asked how this works? Zach stated that the Village is awarded the grant and then business owners would fill out an application for the funding of their project. Zach explained again this is just for the planning, not the actual work that will be done. This is a process, it will take some time. Troutman made a motion to close the Public Hearing on the Village Applying for a $53,000.00 grant for the Development of a Downtown Revitalization Plan. Hightree seconded the motion. Troutman made a motion to approve the Village of Decatur, Nebraska to apply for a $53,000.00 for the Development of a Downtown Revitalization Plan. Hightree seconded the motion. Village Board of the Village of Decatur, that the Board Chair be authorized and directed to proceed with the formulation of any and all contracts, documents or other memoranda between Village of Decatur and the Nebraska Department of Economic Development so as to effect acceptance of the grant application. Chairman Anderson signed the Citizen Participation Plan. Attest: Therese Magill Village Clerk 7. Steve Brown Building Permit 1302 South 2nd Avenue. Steve and Maddie Brown came to the table. They want to come to a peaceable and sensible solution to the problems with the neighbors. They came and got a building permit application for a 20 x 20 garage, her husband put 2 x 4’s out on the ground where the building was going to be placed, they received a signed permit for the building, and built the garage. Apparently, the building is not in the right place and the neighbor is incredibly upset. They do not want to fight with the neighbor or the Village. She stated apparently the building is only a foot off the property line, and the neighbors tree limbs were on their property. They built it in good faith, and they cannot find anyone to move the building. The neighbor is demanding that they pay for a tree. Anderson stated that we are not going to discuss the trees, that is a civil matter between them and their neighbor. We are only going to discuss the building. Maddie stated that her husband wants to put an 8-foot privacy fence up between the two properties. She stated that the building needs to be moved 7 feet back into their property line. She also stated she does not remember being told the setbacks. She stated that it was laid out on the property and she received the permit so she thought everything was okay. Maddie stated what do we do now? Anderson stated that the Clerk called you on February 23 and told you the building had to be moved. Maddie stated that she would have the building moved, when the weather permitted. Anderson stated that he thought this was all done. Maddie stated that she cannot find anyone to move the building. The building is not bolted on the concrete; it is basically a carport that is enclosed. The board gave the Brown’s two names to see if they could move the building. The Clerk will give the Brown’s the phone numbers tomorrow. The concrete will have to be 8-foot off the property line also. Steve Brown asked if everyone had to be 8-foot off the property line? The Board stated the setbacks are different for each part of the zoning districts. It is not our Building Inspectors responsibility to find the home owners pins, that is the home owner’s responsibility to mark where the property line pins are located. The Brown’s stated that they relied on the signed permit. Hightree stated that you have to follow the rules. Steve stated does this include other garages, porches and steps? Hightree stated yes, you have to off your neighbor’s right-of-way. Steve commented so our neighbors have to move their steps since they are not off the property line 8-foot? Hightree asked him if he went and measured them? Steve stated yes, he did today from his property. Hightree asked if he had his property surveyed? Steve stated not as of yet. Hightree stated the building has to be moved, we cannot change the laws. 8. Teri & Stan Teutsch Response. The Teutsch’s came to the table. They brought a letter and pictures of the tree debris, and the building. Stan stated it is a garage and not a carport, also none of the setbacks were not marked on the application. Teri stated that there has been plenty of time to get the building moved and the tree debris cleaned up. The Teutsch’s asked the Board how much time do they have to get this taken care of? Troutman stated it could take more than two months if they have the property surveyed. There is no definite time frame. Teri asked if the Brown’s needed to come back if it is not done in a timely fashion? Hightree stated if it is not taken care of in 4-6 months someone needs to come back to the Board members. Stan stated they have a 10 x 30 building on the property that they did not get a permit for. Anderson stated that the building inspector will have to look at the building that was added with no permit. Stan asked about the tree debris that was left. Anderson stated that is a matter between the property owners. Teri asked about the 8-foot privacy fence. Troutman stated that this will be looked into on the height. Anderson stated that if it a wood fence, the bad side has to go to the people’s property that is installing the fence. 9. Kathy Robertson-Cat Maintenance Contract. Kathy did not come to the meeting. 10. Decatur Museum-LB840 Grant. Jim and Jane Judt came to the table. Anderson stated that the Museum applied for LB840 money to put in a storage building. We spoke with our Attorney on this and it is eligible for LB840 money. The Museum is asking for $13,306.00, this is ½ of what the building costs. Hightree made a motion to grant the Museum $16,306.00 to put a new storage building on the property. Kirschenman seconded the motion. Anderson stated that the Museum will receive the money when the building is completed, and they will have to get a building permit. 11. Flow Meter Bid from Electric Pump. Troutman made a motion to order the Open Channel Flow Meter for the Sewer Plant from Electric Pump in the amount of $5,615.00. McCullock seconded the motion. Roll Call: Anderson-yes, Hightree-yes, Kirschenman-yes, Troutman-yes, McCullock-yes. 12. Dates for Running Bid Notice for Garbage Pickup. It has been four years since we put garbage pickup in Decatur out for bids. The invitation to bid will run for three weeks in the Lyons Mirror-Sun and the Plaindealer. The bids should be received by August 14th, 2025 at 4:30 PM. 13. Bid from Cass Plumbing for Replacing One Fire Hydrant, and repairing another. The bid for the replacement of the fire hydrant is $9,500.00, for the repair to the other is $3,650.00. Troutman made a motion to accept the bids from Cass Plumbing & HVAC for replacement of one fire hydrant and repairing the other: in the amount of $13,150.00. McCullock seconded the motion. Second Reading of Ordinance #05-2025 Regarding Procurement and Bidding. Award Bid for Concrete Work. The Board received a bid tabulation for the bids received June 5th, 2025 for the 2025 Pavement Improvements. The Village Engineer reviewed the bids for the completeness and did not find any issues. The Engineer recommended that the Village considers the Award of the Bid to the low bidder, Boden Construction LLC, for $28,125.00. Troutman made a motion to Award of the Bid to the lower bidder, Boden Construction in the amount of $28,125.00 for concrete improvements. Hightree seconded the motion. The Clerk wanted to share the emails with the Board from the Village Attorney and Village Engineer. Troutman suggested putting it out for bids. It would have to be put in the 2025-2026 Budget. There was much discussion about this project. 18. The Board needs to schedule a meeting for Public Comment on the Financial Assistance in the amount of $30,000.00 that we are asking for from the USDA for a Grant for Repairing the water tank and installing a new water line on North 4th Avenue. The Public Notice needs to be ran in the newspaper for two consecutive weeks. The Board decided that June 30, 2025 at 4:30 PM. They will also add the new police officer on the special meeting agenda. 7) CORRESPONDENCE AND ANNOUNCEMENTS 1. Next Regular Board Meeting, Thursday, July 10th, 2025 at 4:30 PM. 2. Weather permitting the dump will be open the 1st and 3rd weekends. Saturday 8:00 AM to 12:00 PM Sunday 1:00 PM to 5:00 PM 3. An officer, so long as fully certified, may make a stop anywhere within the corporate limits of the Village including on any portion of a highway within the Village Corporate limits. The money for any tickets written goes to the School District, other than Overweight Tickets. If we receive money directly for any Ordinance Violations (including parking), we should remit to the County, the County then remits it to the School Fund. 4.
