NOTICE OF INTENT TO SELL REAL PROPERTY CITY OF LYONS, NEBRASKA Notice is hereby given that the City of Lyons, Nebraska, by resolution of its Council, has directed a sale of the following real property owned by it: That part of Lots 10 and 11, Block 8, City of Lyons, Burt County, Nebraska, more particularly described as follows: Beginning 100.54 feet East of the Northwest corner of Block 8; thence East 62.03 feet; thence South 130 feet; thence West 62.03 feet; thence North 130 feet, to the point of beginning (Parcel ID No. 311611900) (the “Property”). Any individual or entity desiring to submit a responsive bid shall do so, under seal, to the Office of the City Clerk, 335 Main St. PO Box 598, Lyons, NE 68038, so it is received in the Clerk’s office no later than March 7, 2025, at 4:30 p.m. Any bid received after such date and time shall not be considered. Any bid shall be conspicuously marked or otherwise identified to be submitted in response to this Resolution. Any bid submitted in any other manner shall not be considered. Bids shall be opened at the regular meeting of the City Council on March 11, 2025, at 5:30 p.m. Terms and conditions of sale are as follows: Terms and conditions of sale are as follows: The City intends to sell the Property to the most responsive bidder. Bidders shall include in the bid the proposed purchase price and a detailed description of the bidder’s intended use of the Property upon sale, including a proposal or plan, together with any and all pertinent documentation, for the construction or other improvement on the Property that, in the City’s judgment, will most increase the property’s taxable value and is most consistent with the purposes for which the property is zoned. The construction or improvement shall commence no later than six (6) months, and shall be completed within eighteen (18) months, after the date of closing of sale, or as otherwise extended by the City Council for good cause shown; if not so completed, ownership of the Property shall revert to the City. The Property is being sold “as is,” without warranty of any kind, and subject to any and all restrictions and encumbrances of record and subject to compliance with any and all Nebraska laws governing the procedure of the sale of real property by a Nebraska city of the second class. Conveyance shall be by quitclaim deed with a possibility of reverter, whereby ownership of the Property will revert to the City in the event construction is not completed within eighteen (18) months, or as otherwise extended by the City Council for good cause shown, from the date of closing of sale. The City shall consider all reasonable bids, but reserves the right to reject any and all bids and reserves the right to request additional information and supporting documentation from any bidder prior to the award of any bid. The minimum bid shall be $1,000. Sale shall be confirmed by ordinance that will identify the purchaser and terms of sale. The City shall remain in possession of the Property until such confirmation and closing of sale.
